1Agreement to These Terms
These Terms and Conditions ("Terms") are an agreement between you and Next Matter Pro ("we," "us," or "our") for your use of the Next Matter Pro Academy training portal at nextmatterpro.com/training (also reachable at training.nextmatterpro.com) and the Next Matter Pro Academy Android app (together, the "Portal").
By creating an account, logging in, or continuing to use the Portal, you agree to these Terms. You also confirm that you have read our Privacy Policy and Cookies Policy. If you do not agree, do not use the Portal. Under the Electronic Commerce Act (Republic Act No. 8792), accepting these Terms online is as binding as signing them on paper.
The Pabulong desktop app is covered by separate Pabulong Terms of Use.
2Eligibility and Your Account
- You must be at least 18 years old to create an account.
- Give accurate information when you register and keep it up to date.
- An account is for one person only. Do not share your login or let anyone else use your account.
- Keep your password secret. You are responsible for activity on your account. Tell us right away at clientcare@nextmatterpro.com if you suspect someone else has accessed it.
- New accounts need admin approval. We may decline a registration, for example if the details are incomplete or appear false.
3Courses, Classes, and Live Sessions
- Each course or class page describes what it includes, its schedule, and its price. That description forms part of your agreement with us for that course or class.
- We may update course content to keep it accurate and current. We will not remove the core content of a paid course while you are enrolled in it.
- If a live session has to be moved, we will give you as much notice as we can.
- Live sessions in the Portal run on a third-party video service (8x8). We do not record or transcribe them.
- We may record paid live classes so that students enrolled in that class can rewatch them in the Portal. If you take part, your name, voice, video, and chat messages may appear in the recording. Recordings are only for students enrolled in that class and cannot be downloaded.
- Do not record, screenshot, or share live classes, recordings, or other participants without the consent of everyone shown or heard.
4Intake Call Practice and Recordings
Some classes include the Academy intake desk, where you take practice phone calls from simulated callers and fill in a practice intake form. Your trainer assigns it to you or to your class. These terms apply when you use it.
- Fictional calls. The callers, firms, attorneys, and cases on the intake desk are fictional. The calls are training exercises. They are not legal or medical advice, and they do not show how any real law firm handles its calls.
- Recording. To take a call, you allow your browser to use your microphone. Each practice call is recorded. We keep the audio recording, a written transcript, what you type into the practice form, the outcome you choose, and when the call happened and how long it lasted.
- Scores and review. When you hang up, the call receives an automated score out of 100 with comments on each part of the call. The score is feedback for your training. Your trainer can listen to the recording, read the transcript, and add their own score and feedback.
- Google Gemini. The simulated callers, the transcripts, and the automated scores run on Google's Gemini API. During and after a call, your voice, the transcript, and your practice form entries are sent to Google. Google's Gemini API Additional Terms and Privacy Policy apply to what Google receives. Under those terms, Google may use this content to provide, improve, and develop its products, and people at Google may review it.
- Your agreement. Before your first practice call, the intake desk shows a short notice about recording and Google's processing. You need to accept it to take calls. If you do not want your voice processed this way, do not use the intake desk and tell your trainer.
- Use only fictional details. During a practice call, use only the details from the fictional case. Do not say or type real personal information about yourself or anyone else, such as real client details, government ID numbers, or health information.
- Limits. Each call lasts up to 10 minutes, and the desk limits how many calls you can start each day. The simulated caller may end the call if the line is silent too long, if you leave the caller on hold too long, or if you are rude or go off topic.
- Who can play your calls. Only you, your trainers, and Academy admins can play your recordings and see your results. Do not record, copy, or share practice calls outside the Portal.
- Location. Google does not allow the Gemini service the intake desk uses to be offered to people in the European Economic Area, Switzerland, or the United Kingdom. If you are there, do not use the intake desk.
4ARecords Practice Desk and Recordings
Some classes include the Academy records desk, where you work practice shifts as a medical records specialist: you request records on a practice case system, send practice faxes and emails, use practice records portals, upload documents you draft, and take practice phone calls with simulated provider staff. Your trainer assigns it to you or to your class. These terms apply when you use it.
- Fictional work. The firm, patients, providers, medical records, bills, and calls on the records desk are fictional. Faxes and emails you send there stay inside the desk and are never delivered to anyone. The shifts are training exercises. They are not legal or medical advice, and they do not show how any real law firm or provider works.
- Practice portals. The Datavant, ChartSwap, and MRO screens on the records desk are practice copies made for training. They are not affiliated with or endorsed by those companies and do not connect to them. Never enter a real login, password, or card number on the records desk.
- Uploads. You can upload documents you draft, such as a records request letter, as a Word file or a PDF of up to 10 MB. We store them privately with your shift.
- Recording. To take a practice call, you allow your browser to use your microphone. Each practice call is recorded. We keep the audio recording, a written transcript, and when the call happened and how long it lasted. We also keep what you do on the desk during a shift, such as the requests you log, faxes, emails, portal actions, and when you did them.
- Scores and review. When you submit a shift, it receives an automated score out of 100, made of checks the desk runs on your work and automated scores of your calls and of the letter or email you wrote. The score is feedback for your training. Your trainer can listen to your calls, read your work, and add their own score and feedback.
- Google Gemini. The simulated provider staff and callers, the call transcripts, and the automated scores of your calls, letter, and email run on Google's Gemini API. Your voice, the transcripts, your call log entries, the documents you upload, and the emails you write on the desk are sent to Google. Google's Gemini API Additional Terms and Privacy Policy apply to what Google receives. Under those terms, Google may use this content to provide, improve, and develop its products, and people at Google may review it.
- Your agreement. Before your first shift, the records desk shows a short notice about recording, uploads, and Google's processing. You need to accept it to start a shift. If you do not want your work processed this way, do not use the records desk and tell your trainer.
- Use only fictional details. Use only the details from the fictional case. Do not say, type, or upload real personal information about yourself or anyone else, such as real patient or client details, government ID numbers, health information, or card numbers.
- Limits. Each call lasts up to 10 minutes, and the desk limits how many calls and shifts you can start each day. The simulated staff may end a call if the line is silent too long, or if you are rude or go off topic.
- Who can see your work. Only you, your trainers, and Academy admins can play your recordings, open your uploads, and see your results. Do not record, copy, or share practice calls outside the Portal.
- Location. Google does not allow the Gemini service the records desk uses to be offered to people in the European Economic Area, Switzerland, or the United Kingdom. If you are there, do not use the records desk.
4BDemand Practice Desk and Recordings
Some classes include the Academy demand desk, where you work a practice shift as a demand writer: you audit a fictional client's file on a practice case system, send practice faxes and emails, use practice records portals, build a chronology and a damages ledger, upload the demand letter you draft, and take practice phone calls with simulated staff and a simulated insurance adjuster. Your trainer assigns it to you or to your class. These terms apply when you use it.
- Fictional work. The firm, the client, the providers, the medical records, bills, police reports, insurance letters, and calls on the demand desk are fictional. Faxes and emails you send there stay inside the desk and are never delivered to anyone. The shift is a training exercise. It is not legal or medical advice, and it does not show how any real law firm, provider, or insurer works.
- Practice portals. The Datavant and ChartSwap screens on the demand desk are practice copies made for training. They are not affiliated with or endorsed by those companies and do not connect to them. Never enter a real login, password, or card number on the demand desk.
- Uploads. You can upload documents you draft, such as the demand letter, as a Word file or a PDF of up to 10 MB. We store them privately with your shift.
- Recording. To take a practice call, you allow your browser to use your microphone. Each practice call is recorded. We keep the audio recording, a written transcript, and when the call happened and how long it lasted. We also keep what you do on the desk during the shift, such as the inventory, issues, chronology, ledger, and notes you enter, the faxes, emails, and portal actions, and when you did them.
- Scores and review. When you submit the shift, it receives an automated score out of 100, made of checks the desk runs on your work, automated scores of your calls, and an automated review of the demand letter you wrote, including a check of every amount and date in it against the file. The score is feedback for your training. Your trainer can listen to your calls, read your demand and your desk entries, and add their own score and feedback.
- Google Gemini. The simulated staff and adjuster, the call transcripts, and the automated scores of your calls and your demand letter run on Google's Gemini API. Your voice, the transcripts, your call log entries, and the documents you upload on the desk are sent to Google. Google's Gemini API Additional Terms and Privacy Policy apply to what Google receives. Under those terms, Google may use this content to provide, improve, and develop its products, and people at Google may review it.
- Your agreement. Before your shift, the demand desk shows a short notice about recording, uploads, and Google's processing. You need to accept it to start. If you do not want your work processed this way, do not use the demand desk and tell your trainer.
- Use only fictional details. Use only the details from the fictional case. Do not say, type, or upload real personal information about yourself or anyone else, such as real client or patient details, government ID numbers, health information, or card numbers.
- Location. Google does not allow the Gemini service the demand desk uses to be offered to people in the European Economic Area, Switzerland, or the United Kingdom. If you are there, do not use the demand desk.
4CResume Builder
The resume builder turns your answers into a resume you can download as a Word file, a PDF, or plain text. These terms apply when you use it.
- Your facts. The builder writes only from what you enter and from your Academy records. Check every line before you use it. You are responsible for making sure your resume is true. Do not add jobs, numbers, programs, or credentials you do not have.
- Training, not employment. Academy courses, certificates, and practice desks appear as training. Practice desks show that you completed simulated work reviewed by a trainer, never a score. The Academy is not your employer, and using the builder does not mean we will place you in a job.
- Google Gemini. The AI tools (improve the wording of a bullet or the summary, or suggest bullets for a job) are optional and run on Google's Gemini API. When you press one, the text of that bullet or summary, or the answers and lines of that job, are sent to Google. Your name and contact details are not sent. Google's Gemini API Additional Terms and Privacy Policy apply to what Google receives. Under those terms, Google may use this content to provide, improve, and develop its products, and people at Google may review it. What the AI suggests is only a suggestion: your text changes only when you accept it.
- Limits. The AI tools have daily limits and may not always be available. The rest of the builder works without them.
- Verification link. If you add your training verification link to your resume, anyone with the link can see your name and your valid course and learning track certificates.
- Location. Google does not allow the Gemini service the AI tools use to be offered to people in the European Economic Area, Switzerland, or the United Kingdom. If you are there, do not use the AI tools.
5Fees and Payments
- Prices are shown on the class page and at checkout before you pay.
- Payments are processed by PayMongo. Your payment details are subject to PayMongo's own terms and privacy policy.
- Your enrollment is confirmed once your payment has been received and verified.
- If a payment is reversed, charged back, or found to be fraudulent, we may suspend access to the class concerned until it is resolved.
- Referral discounts. A friend who joins using your referral link or code gets 10% off their first paid class. When their payment goes through, you get 10% off your next paid class, applied automatically at checkout. Only one discount applies per purchase. Discounts have no cash value and cannot be transferred. You cannot refer yourself, and we may cancel discounts obtained through fake or duplicate accounts or other abuse. We may change or end the referral offer, but discounts you have already earned will still apply.
6Cancellations and Refunds
- If we cancel a paid class and cannot offer another date that works for you, we will refund the full amount you paid for it.
- Any other refund terms for a course or class are shown on its page at the time you buy it.
- To request a refund, email clientcare@nextmatterpro.com with your name, the class, and your payment reference. We handle refund requests in good faith and as required by the Consumer Act of the Philippines (Republic Act No. 7394) and other applicable law.
- Approved refunds are returned to the original payment method.
7Certificates
- Certificates are issued when you complete a course's requirements.
- Each certificate has a number. Anyone with that number can confirm online that it is genuine and see your name, the course title, and the issue date.
- A certificate confirms that you completed a Next Matter Pro Academy course. It is not a government license, an academic degree, or a professional accreditation.
- We may withdraw a certificate that was obtained through cheating, impersonation, or false information.
8No Guarantee of Employment or Income, and No Legal Advice
Our courses teach skills for virtual assistant work, including work that supports law firms. Completing a course does not guarantee a job, clients, or any level of income. Course materials are for training purposes only. They are not legal advice and do not create a lawyer–client relationship.
9Acceptable Use
When using the Portal, you agree not to:
- harass, threaten, or abuse instructors, staff, or classmates;
- upload or send anything unlawful, defamatory, obscene, infringing, or harmful, including malware;
- share other students' personal data, messages, or files outside the Portal without their permission;
- copy, resell, publicly post, or distribute course materials;
- try to get into accounts, data, or parts of the Portal you are not authorized to use, or disrupt how it works;
- try to make the intake desk's simulated caller talk about anything other than the practice call, get around its limits, or use it for anything other than intake practice;
- try to make the records desk's simulated staff or callers talk about anything other than the practice call, get around the desk's limits, or use it for anything other than records practice;
- try to make the demand desk's simulated staff or adjuster talk about anything other than the practice call, get around the desk's limits, or use it for anything other than demand practice;
- scrape the Portal or collect data from it by automated means;
- send spam or unsolicited advertising through the Portal;
- use the Portal for any illegal purpose.
10Your Content
You own the messages, files, and other content you upload ("Your Content"), including work you hand in for assignments, your side of practice call recordings and what you type on the intake desk, questions and replies on lesson pages, reviews, and your profile details and résumé. You give us a non-exclusive, royalty-free permission to store, display, and transmit Your Content only as needed to run the Portal. For example, we deliver your message to the people you send it to, our trainers review the work you hand in and your practice calls, and practice call content is sent to Google as described in Section 4. You are responsible for Your Content and confirm that you have the right to share it. We may remove content that breaks these Terms.
- Your profile and résumé. Background details are optional. Anything you add must be accurate and about you. Do not include other people's personal data, or government ID numbers and similar details, in your résumé. You can change or remove these details at any time.
- Questions and replies on lesson pages are visible to other students taking the same course, with your first name and last initial.
- Reviews must reflect your own experience of a class or course. We check reviews before publishing them, show them with your first name and last initial, and may decline or remove reviews that are abusive, misleading, off-topic, or contain personal data. We do not change the words of a review.
11Our Content and Intellectual Property
Course materials, videos, handouts, templates, the Portal's design, and the Next Matter Pro name and logo belong to Next Matter Pro or its licensors. They are protected by the Intellectual Property Code of the Philippines and other laws. While you are enrolled, we give you a personal, non-transferable, non-exclusive permission to use course materials for your own learning. You may not copy, share, sell, or publish them, or use them to create competing courses, without our written permission.
12Third-Party Services and Ads
The Portal relies on third-party services, including PayMongo (payments), 8x8 (live video), Google Gemini API (the simulated callers, transcripts, and scoring on the intake desk, the records desk, and the demand desk, and the optional AI tools in the resume builder), Google Firebase (app notifications), and Google AdSense (ads on public pages). Those services are governed by their own terms. We are not responsible for them, or for external websites we link to.
13Suspension and Closing Your Account
- You can close your account at any time by emailing clientcare@nextmatterpro.com. Our Privacy Policy explains what happens to your data.
- We may suspend or close an account that breaks these Terms, puts other users or the Portal at risk, or is used fraudulently. Where appropriate, we will tell you why first and give you a chance to respond.
- If we close your account because you broke these Terms, you may not be entitled to a refund for classes you did not complete, except where the law requires one.
- Sections that by their nature should continue after your account closes, such as intellectual property, disclaimers, limitation of liability, and governing law, will continue.
14Disclaimers
We work to keep the Portal accurate, available, and secure. However, it is provided "as is" and "as available." We do not promise that it will always be uninterrupted or error-free. This does not limit any rights you have as a consumer that cannot be waived under Philippine law.
15Limitation of Liability
As far as the law allows, we are not liable for indirect or consequential losses, such as lost income, lost opportunities, or lost data, arising from your use of the Portal. Our total liability to you for any claim about a course or class is limited to the amount you paid us for that course or class.
Nothing in these Terms limits our liability for fraud, bad faith, gross negligence, or anything else that cannot be limited under Philippine law, including the Civil Code and the Consumer Act.
16Changes to These Terms
We may update these Terms. We will change the "Last updated" date. For significant changes, we will also notify registered users by email or with a notice in the Portal before the changes take effect. If you keep using the Portal after that date, you accept the updated Terms. Changes will not reduce what you already paid for in a class you bought before the change.
17Governing Law and Disputes
These Terms are governed by the laws of the Republic of the Philippines. If you have a concern, please contact us first at clientcare@nextmatterpro.com so we can try to resolve it. If we cannot, the dispute will be decided by the proper courts of the Philippines. This does not stop you from filing a complaint with the Department of Trade and Industry, the National Privacy Commission, or any other government agency that handles consumer or privacy complaints.
